TikTok Faces United States Face Off in Court Over Potential Ban

(VitalNews.org) – TiKTok faced off against the United States government in federal court on Monday, while they argued a law that could ban the platform in just a few short months.

The Justice Department has said that the ban is crucial to eliminate the national security risk that is posed by the social media platform. Attorneys on both sides, along with content creators, appeared before a panel of three different judges at a federal appeals court in Washington. ByteDance, TikTok’s parent company, are at the courts to challenge the law that is forcing them to break ties or lose the United States market and face a ban.

Andrew Pincus is a veteran attorney representing ByteDance and TikTok. Pincus argued that in court, the law is unfairly targeting the company and goes against the First Amendment.

Another attorney is representing creators who are also challenging the law and arguing that it violates the First Amendment rights of those in the United States.

Pincus said, “The law before this court is unprecedented and its effect would be staggering.”

The law was signed by President Joe Biden and was a culmination of a years-long fight over TikTok, which is a social media platform that is seen as a national security threat due to their connections to China.

The United States has continuously said that it is concerned about TiKTok collecting user data, including sensitive information, which could fall into the hands of the Chinese government.

“The problem is that the same data is extremely valuable to a foreign adversary trying to compromise the security of the United States,” said Daniel Tenny, an attorney for the Justice Department.
